What is the Purpose of this Policy?
This policy (together with Web site terms of use) describes how we collect and use personal information about you through the web site: https://www.ugeventi.com, in accordance with the General Data Protection Regulation (GDPR; EU Regulation no.2016/679) and any other national implementing laws, regulations and secondary legislation, as amended or updated from time to time, in the relevant European jurisdiction to which the processing relates (Data Protection Legislation).
Please read the following carefully to understand our practices regarding how we handle information we learn about you from your visit to the Web site www.ugeventi.com.
- Data Controller: ARIIX Italia Srl a company registered office Via dell’ospedaletto Giustiniani 14 00169 Roma (hereinafter referred to also as “ARIIX”)
- Data Processor: Unstoppable Generation S.r.l. – Registered office Via dell’ospedaletto Giustiniani 14 00169 Roma (hereinafter referred to also as “UG”)
- Data security officer: Legal Representative and Chief Executive Officer of Unstoppable Generation Srl.
- Purpose of the data processing: the data provided will be used exclusively under the obligations of the contract with the Data Processor Specifically, the collection of personal data through the registration procedures for the attendance of ARIIX’ first Convention in Italy, which will be held in Rome on October on 11th, 12th and 13th of October 2019, at ugeventi.com, has the purpose to:
- Register the participants at the Convention above;
- Provide the services purchased by participants through such website;
- carry out our obligations arising from any agreements entered into between you and us (including to process, fulfil and notify you of your product order status);
- allow you to participate in interactive features of our service, when you choose to do so;
- notify you about changes to services and/or program;
- Provide information and/or send communications relating to the services above and, more in general, the Convention (such as -but not limited to- full program, timeline and accommodation);
- Ensure all accounting legal and tax/fiscal/accountancy requirements are properly fulfilled;
- Posting of photos on the photo gallery at @ARIIXCorporateEurope (Facebook page), Unstoppable Generation ( Facebook page) and distribution via email to all ARIIX Representatives and other computer and paper media owned by ARIIX ;
The Kind of Information We Hold About You
The personal information and data we collect might include your personal details, such as, your name, address, email address, telephone, mobile number, gender, date of birth, IP address, and information regarding what Web site pages are accessed. We will hold a wider range of information about you regarding address (place of residence), billing address.
If you fail to provide certain information and/or your consent -when requested- to the processing, by us, of your personal data for the following purposes: carry out our obligations arising from any agreements entered into between you and us (including to process, fulfil and notify you of your order status) and perform any obligation set forth by applicable laws and regulations, we may not be able to perform the contract we have entered into with you, or we may be prevented from complying with our legal and contractual obligations.
How We Collect Your Personal Information
We obtain information about you when you use said Web site, for example: (i) when you fill in forms on our site, subscribe to any service, request further services, or contact us about the services; (ii) if you contact us, we may keep a record of that correspondence; and (iii) we collect details of your visits to said Web site including traffic data, location data, weblogs and other communication data, and the resources that you access.
Data dissemination
The person taking part to the Convention authorizes the publication of personal data (photo, images, videos, name) granting their rights of use free of charge for all promotional and editorial purposes in unlimited buyout formula (including but not limited to print advertising, billboards, Internet, social networks, btl material, videos, corporate publications, etc.). The person also ESPRESSES HIS/HER CONSENT to grant to the Data Processor and the Data Controller license free to use his/her photo, images, videos and name, and include the rights referred to in articles from 12 to 19 of the law of 22 April 1941, n. 633, as amended.
It is strictly forbidden to use the aforementioned pictures in contexts that could affect personal dignity and decorum. Posing for and usage of the pictures are free of charge. Such person authorizes their transmission free of charge as appropriate through rectification, adaptation or rework, including multimedia processing, as well as use in any location, form or manner (originating or derivative thereof), with no time, space, passages limit or otherwise, in any language, in any version, using any technical means of transmission (including but not limited to: internet, over-the-air transmission, cable, satellite of any kind and type) in any version, or through any format through any distribution channel, including the Internet, pay TV, pay per view and video on demand. The Processor and Controller becomes the owner of all videos and photos taken during the event and will have the widest and unlimited right to use both videos and photos taken during the event, with regard to the use for which the videos and photographs were taken, and in connection with any possible future further use the controller will decide to make, both nationwide and worldwide. The person taking part to the event will not be entitled to any rights, claims and/or fee and/or compensation, or any other form of compensation thereof, thereby waving any future claim and/or compensation. The Processor and Controller will then be free to use and handle, directly or indirectly, for himself and its successors and assigns, such videos and photos, as well as to amend, modify, change or integrate such materials, regardless of their protection under the law on Copyright, and without any limitation of space (in Italy and abroad), time, and through any medium, and the person taking part to the event waives any claim on such material..
- Recipients of personal data: data collection is performed by the Data processor in the person of the Chief Security Officer for the purposes defined above or for promotions related to services provided by Unstoppable Generation S.r.l.
- Data transfer: Unstoppable Generation S.r.l. as Data Processor will transfer personal data to the Data Controller for the purposes permitted by law. The data will be processed primarily by the Data Processor with electronic devices and computers and stored on computer media. In such case, the data collected during the execution of their services may be stored and managed through ARUBA server according to the indications described at the following link: https://hosting.aruba.it/termini-condizioni.aspx. The data may also be disclosed to accounting/law firms or banks for the payment purposes. We may share your personal information with third parties where required by law, where it is necessary to enter into, administer and perform the relationship with you or where we have another legitimate interest in doing so. We are not in the business of selling your personal information to third parties.
Which third-party service providers process your personal information?
Where permitted by the provisions of applicable law, we may share such information from time to time with the following third parties:
- Any agent, contractor, supplier, vendor, or third party service providers who provides administrative, payment processing, IT, marketing, printing, shipping, fulfilment, web-tools, fraud prevention or other services to connected to the Convention above.
- Professional advisers including bankers, accountants, auditors and insurers who provide consultancy, banking, security, insurance and accounting services.
- Internal Revenue Service, regulators and others, as well as any -also national- competent tax/fiscal and social security Authority, and Public Entities (including Town Municipalities and Police Offices, where required), who require reporting of processing activities in certain circumstances.
All our third-party service providers are required to take appropriate security measures to protect your personal information. We do not allow our third-party service providers to use your personal data for their own purposes. We only permit them to process your personal data for specified purposes and in accordance with our instructions.
Why might you share my personal information with third parties?
We will share your personal information with third parties where it is necessary to enter into, administer and perform the relationship with you or where we have another legitimate interest in doing so. We are not in the business of selling your personal information to third parties.
- Storage periods for personal data: Data will be stored in a way that allows timely identification for the time limited to the purposes for which the data were collected and subsequently processed and, in any case, the storage period of data collected by the Controller is estimated to be five (5) years starting from the end of the contract.
- Your duty to inform us of changes It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes and of which we need to be made aware.
- Pursuant to article 7 of Legislative Decree No. 7 196/2003 and articles from 15 to 22 of EU Regulation no. 2016/679, the data subject has the right to:
- obtain confirmation as to whether or not your personal data are available;
- access information about the purpose of processing, the categories of personal data concerned, the recipients or categories of recipients to whom personal data has been or will be disclosed and, where possible, the storage period;
- request rectification and erasure of personal data;
- request restriction of processing;
- data portability, i.e. to receive personal data from data controller in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance;
- oppose processing at any time, including direct marketing purposes;
- object to an automated decision-making process concerning individuals, including profiling;
- ask the data holder to have access and rectify or delete personal data or to limit data processing concerning the person, or to oppose data processing, besides the right to data portability;
- withdraw consent at any time, without affecting the lawfulness of any processing based on consent given prior to revocation;
- file a complaint with a supervisory authority.
You may exercise your rights sending a written request to Data Controller, at its registered office address or by email at legal@ariix.com.
You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if any request made by you is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.
We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that personal information is not disclosed to any person who has no right to receive it.
If you are not satisfied with our response or believe we are not lawfully processing your data you can also complain to the competent supervisory Authority at any time.
- Consent objection: Refusing to provide data as agreed under the terms of the contract between the parties, could result in failure or cancellation of the contract, or in the failure to continue any relationship between the parties and the inability to use the services offered by Unstoppable Generation S.r.l.. With regard to Data Processing referred to in the preceding paragraph 1. h): consent has to be considered optional for such purposes; therefore refusal to provide data does not determine the inability to take part to the event”
- Unstoppable Generation S.r.l. does not make use of an automated decision-making processfor the processing of data provided by the data subject.
- Different purpose of authorized data: if Unstoppable ARIIX intends to process personal data further, and for a purpose that is different from the purpose intended for their collection, before such further processing, the Data Controller will provide the Data Subject with information on this different purpose and any other relevant information.
- Change of purpose
Your personal data will be used for the purposes for which they are collected, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal information for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.
Please note that we may process your personal information without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
- Right to Withdraw Consent
In the limited circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose (for example, in relation to direct marketing that you have indicated you would like to receive from us), you have the right to withdraw your consent for that specific processing.
You can exercise this option at any time by contacting us, using the contact details outlined below. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law.
